Privacy Policy

This policy explains what information I collect through pennhenderson.com, how I use it, and the choices you have. I have tried to write it in plain language rather than legal boilerplate.

1. Who I Am

This website is owned and operated by Penn Henderson, a licensed Hawaii real estate salesperson (License RS-83962) affiliated with Compass (License RB-23206-2). Throughout this policy, “I,” “me,” and “my” refer to Penn Henderson.

2. What This Policy Covers

This policy applies to pennhenderson.com and to information you provide to me directly. It does not apply to compass.com, to the Compass Home Platform, or to any other website or platform operated by Compass. Those are governed by Compass’s own privacy policy.

It also does not cover the practices of other companies whose services appear on or connect to this site. Section 10 lists those, and I encourage you to review their policies.

This site is intended for visitors in the United States.

3. Information I Collect

Information you give me

When you fill out a contact form, request a home valuation, register for property search, or reach out by phone or email, I collect what you provide. Depending on the form, that may include your name, email address, phone number, mailing or property address, property details you describe, your buying or selling timeline, whether you are already working with an agent, and any comments you write.

Information collected automatically

When you visit, certain information is collected by the site and by the analytics and advertising services I use. This includes your IP address, browser type and version, device type and operating system, screen size, referring website, pages viewed, time spent on pages, links clicked, and the approximate geographic location associated with your IP address.

Property search activity

If you use the property search, the IDX system records which listings you view, save, and share, along with your search filters and saved search criteria. Section 4 explains this in more detail because it is the most significant collection that happens on this site.

Information from other sources

I may receive information about you from the MLS, from Compass, from other real estate professionals involved in a transaction, from public records, or from lead sources such as Zillow or Realtor.com if you contacted me through one of those platforms.

4. Property Search Registration and Activity Tracking

The property search is powered by iHomeFinder using listing data from Hawaii Information Service. After viewing a set number of listings, you will be asked to register with your name, email address, and phone number in order to continue.

What happens once you register. Your registration creates a contact record. From that point forward, the listings you view, the searches you run, the properties you save, and the alerts you set up are recorded and associated with that record. That activity is visible to me and is transferred into the customer relationship management systems described in Section 10.

How I use it. I use this to understand what you are looking for so I can send relevant listings and follow up in a useful way rather than a generic one. Some systems assign engagement scores based on activity. Those scores inform how and when I follow up. They are not used to make any decision about your eligibility for housing, financing, or services.

If you would rather not register. You are welcome to search MLS listings elsewhere, or contact me directly at (808) 345-6214 or penn@pennhenderson.com and I will send you listings without any registration. You can also ask me at any time to delete your search account and the activity history attached to it.

5. Cookies and Similar Technologies

This site uses cookies and similar technologies such as pixels, tags, and local storage. Some are necessary for the site to function, including keeping you logged in to property search and remembering saved listings. Others support analytics and advertising.

You can control cookies through your browser settings. Most browsers let you block cookies, delete existing ones, or alert you before one is set. Blocking cookies will affect how parts of this site work, particularly saved searches and property alerts.

Browser-level controls are available in the privacy or security settings of Chrome, Safari, Firefox, and Edge.

6. Analytics and Advertising

I use the following services to understand how the site is used and to reach people who may be interested in Big Island real estate.

Service	What it does
Google Analytics 4	Measures traffic, pages viewed, and how visitors move through the site. Data is processed by Google.
Google Ads	Tracks which ads lead to inquiries so I can measure whether advertising is working, and may show you ads on Google properties after you visit.
Meta Pixel	Records visits and form submissions and reports them to Meta, which may be used to show you ads on Facebook and Instagram.

These services set their own cookies and may combine information about your visit here with information they hold about you from elsewhere. I do not control what they collect or how they use it. Their practices are governed by their own privacy policies.

Advertising and fair housing

Real estate advertising is subject to fair housing law. I do not target or exclude audiences for housing advertising on the basis of race, color, religion, sex, familial status, national origin, disability, or any other protected characteristic. Housing advertisements I run through Meta are placed under Meta’s restricted housing advertising category, which limits targeting accordingly.

7. Compass Pixel and Website Activity Tracking

This site runs a tracking pixel provided by Compass, my brokerage. It loads on every page, including property search pages, and it feeds directly into the Compass customer relationship management system.

What it collects

• Pages you view and the sequence you view them in
• Property listings and community pages you open
• Date, time, and duration of your visits, including repeat visits over time
• Your IP address, browser, device type, and operating system
• The website, search, or advertisement that referred you here
• Information you enter into contact and inquiry forms, including your name, email address, and phone number

Form submissions

When you submit a form on this site, the information you provide is sent to Compass in addition to being sent to me by email. Compass may use it to create a contact record, to validate and standardize the contact details you entered, and to route the inquiry.

Connecting earlier visits to you

Before you identify yourself, your activity is recorded without a name attached. Once you submit a form or are otherwise identified, Compass may associate that earlier activity with your contact record. The practical effect is that I can see which pages and listings you looked at on prior visits, going back before the point at which I knew who you were.

How I use it

I use this to understand which areas, property types, and price ranges actually interest you, so my follow up is relevant rather than generic. It also tells me when someone is actively searching, which affects how quickly I reach out. This information is never used to make any decision about your eligibility for housing, financing, or services, and it is not used to target or exclude audiences on the basis of any protected characteristic.

Your choices

The browser-level cookie controls described in Section 5 apply here. You can also block the pixel with most tracker-blocking browser extensions, or use a browser with tracking protection enabled. Blocking it will not affect your ability to browse this site, though it may affect property search features that rely on cookies.

If you would rather not be tracked at all, contact me directly by phone or email instead of using a form on this site.

Compass processes this information under its own privacy policy, available at compass.com. If you are a resident of California or another state with a comprehensive privacy law, the transmission of this information to Compass may be treated as sharing personal information with a third party for commercial purposes. You may direct me not to share your information by emailing penn@pennhenderson.com.

8. How I Use Your Information

• Respond to your questions and requests
• Send property listings, saved search alerts, and market information you asked for
• Prepare home valuations and market analyses you request
• Provide real estate brokerage services and support a transaction
• Send newsletters and marketing communications you can opt out of at any time
• Understand how the site is used and improve it
• Measure and improve advertising
• Maintain records required by Hawaii real estate law and brokerage policy
• Protect against fraud, abuse, and security threats
• Comply with legal obligations

I do not sell your personal information for money.

9. How I Share Your Information

I share information in the following circumstances.

With Compass. As a Compass-affiliated agent, client and transaction information is processed through Compass systems, and Compass may access it in accordance with its own policies and its obligations as my brokerage. As described in Section 7, website activity and form submissions from this site are also transmitted to Compass through the Compass Pixel.

With service providers. The companies listed in Section 10 process information on my behalf to run the site, manage contacts, and send communications.

With transaction parties. If you engage me in a transaction, I share information as necessary with the other party’s agent, escrow and title companies, lenders, inspectors, appraisers, and similar participants.

With the MLS. If I list your property, listing information is submitted to Hawaii Information Service, which distributes it to other brokerages and to public-facing sites including Zillow and Realtor.com. Once a listing is published this way, I cannot recall it from those sites.

For legal reasons. I may disclose information when required by law, subpoena, or court order, or to protect rights, property, or safety.

In a business transfer. If my business is sold or transferred, client information may transfer as part of it.

Each of these companies maintains its own privacy policy governing what it does with information it receives.

11. Communications and Opt-Out

When you provide your contact information, you consent to be contacted by email, phone, or text regarding your inquiry and regarding properties and market information that may interest you.

Email. Every marketing email includes an unsubscribe link. You can also email me and I will remove you.

Text messages. Reply STOP to opt out or HELP for assistance. Message frequency varies and message and data rates may apply. Agreeing to texts is never a condition of receiving real estate services.

Phone. Tell me and I will note it in my records.

Opting out of marketing does not stop communications directly related to an active transaction.

This opt-out applies to communications from me. Compass, lenders, and other third parties maintain separate lists with their own opt-out procedures.

12. Your Privacy Choices

Regardless of where you live, you may ask me to:

• Tell you what personal information I hold about you
• Provide a copy of it
• Correct anything inaccurate
• Delete it
• Stop sending you marketing
• Close your property search account and remove the activity history attached to it
• Stop sharing your information with Compass through the pixel described in Section 7

Email penn@pennhenderson.com or call (808) 345-6214. I may need to verify your identity before acting on a request. I will respond within 45 days.

Some information cannot be deleted where I am required to retain it under real estate record-keeping obligations or where it exists in MLS or public records outside my control.

Residents of California, Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws may have additional statutory rights. My business may fall below the thresholds that trigger those laws, but I will honor the requests above regardless.

13. Do Not Track and Global Privacy Control

Web browsers offer a Do Not Track signal, but there is no common standard for how sites should respond, and this site does not currently respond to it.

Where technically supported, I honor the Global Privacy Control signal as an opt-out request for the sharing of personal information for targeted advertising. You can learn more at globalprivacycontrol.org.

14. How Long I Keep Information

I keep information as long as needed for the purpose it was collected, and longer where a legal or brokerage obligation requires it.

• Inquiries that do not become transactions: retained in my contact systems until you ask me to delete them
• Transaction records: retained as required by Hawaii real estate law and Compass record retention policy
• Property search accounts: retained until you close the account or ask me to
• Website activity captured by the Compass Pixel: retained by Compass under its own retention practices
• Analytics data: retained according to the settings of the services in Section 6

15. Security

I use reasonable measures to protect information, including encrypted connections, hosting with reputable providers, and access controls on the systems I use.

No method of transmission or storage is completely secure, and I cannot guarantee absolute security. Please avoid sending sensitive information such as Social Security numbers, bank account numbers, or wire instructions through unsecured email.

16. Children’s Privacy

This site is not directed to children, and I do not knowingly collect personal information from anyone under 16. If you believe a child has provided information here, contact me and I will delete it.

17. Changes to This Policy

I may update this policy as the site or my practices change. The revised version takes effect when posted, and the date at the top will reflect the change. Significant changes will be noted on this page.

August 25, 2026. Added Section 7 describing the Compass Pixel, which collects website activity and form submissions and transmits them to Compass.
